By accessing or using ragam.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

ragam.ai is a music processing platform that provides audio enhancement tools including Lo-Fi processing, AI mastering, stem separation, and format conversion. The Service is provided on a freemium basis with optional paid subscriptions for additional features.

3. Account Registration

To access certain features, you must create an account using Google authentication. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. User Content and Rights

4.1 Your Content

You retain all ownership rights to the audio files you upload ("User Content"). By uploading content, you grant us a limited, non-exclusive license to process your audio solely for the purpose of providing the Service.

4.2 Content Responsibility

You represent and warrant that:

• You own or have the necessary rights to the audio you upload
• Your content does not infringe any third-party intellectual property rights
• Your content does not violate any applicable laws
• You have obtained all necessary permissions for any samples or copyrighted material

4.3 Prohibited Content

You may not upload content that:

• Infringes copyrights, trademarks, or other intellectual property rights
• Contains illegal material or promotes illegal activities
• Contains malware, viruses, or harmful code
• Is defamatory, obscene, or promotes hatred

5. Service Tiers and Payment

5.1 Free Tier

• 2 exports per day
• MP3 format only
• Audio watermark on exports
• 7-day file storage

5.2 Pro Tier

• Unlimited exports
• MP3 + WAV formats
• No watermark
• 30-day file storage
• Priority processing

5.3 Payment Terms

Pro subscriptions are billed monthly or annually. Prices are in Indian Rupees (INR) and include applicable taxes. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are handled on a case-by-case basis.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to bypass usage limits or security measures
• Reverse engineer or copy our technology
• Use automated systems to access the Service (bots, scrapers)
• Resell or redistribute the Service without permission
• Interfere with or disrupt the Service
• Impersonate others or provide false information

7. Intellectual Property

The Service, including its design, features, and technology, is owned by ragam.ai and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without express written permission.

The ragam.ai name, logo, and branding are trademarks of ragam.ai. You may not use our trademarks without prior written consent.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAGAM.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR INR 5,000, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify and hold harmless ragam.ai, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through your account settings.

12. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

The seat of arbitration shall be Bangalore, Karnataka, India. The language of arbitration shall be English. The courts of Bangalore shall have exclusive jurisdiction over any matters not subject to arbitration.

13. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and ragam.ai.
• Severability: If any provision is found invalid, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any right does not constitute a waiver of that right.
• Assignment: You may not assign these Terms without our consent.
